Rental Bicycle Use / レンタサイクル利用について

These terms and conditions apply to the facility “Kiyomizu-an House” (from now on referred to as “the Facility”) managed and operated by Raban Designs Ltd. (from now on referred to as the “Operator”), a facility managed and operated by Rurban Designs Ltd. (from now on referred to as the “Operator”), a facility managed and operated by Raban Designs Ltd. When using the Facility, please fully understand and abide by the terms and conditions of this Agreement. In addition to these Rules and Regulations, the Operator may establish rules and regulations as necessary, which must also be observed. The Operator may occasionally amend these Terms and Conditions and the Rules and Regulations without prior notice and shall notify prospective users and users of any amendment during the Term of Use as the Operator deems appropriate. Any matter not stipulated in these Terms and Conditions shall be subject to laws, regulations, or general customs.

本規約は、有限会社ラーバンデザインズ（以下「運営者」といいます。）が管理・運営する施設「清水庵」（以下「本施設」といいます。）のレンタサイクルについて定めるものです。ご利用に際しては、本規約の内容を十分にご理解いただき 、これを遵守してください。また、運営者は、本規約の他にも必要に応じて規程または規則を定めることがあり、これらについても遵守をお願いします。なお、運営者は、本規約および規程等を予告なく適宜変更することができ、利用期間中に変更したときは、運営者が適当と認める方法にて 利用希望者および利用者に通知するものとします。なお、本規約に定めのない事項については、法令又は一般の慣習に従うものとします。

 Eligibility for Use / 利用資格 

Users who conform to all of the following may only use rental items.

  1. Must be able to abide by these Terms and Conditions and other traffic rules and regulations of the facility.
  2. Must be able to maintain a means of communication with the facility.
  3. The user must not be under the influence of alcohol.
  4. Suppose the user is not a Japanese citizen. In that case, the user must have travel insurance with sufficient coverage for injuries and damages while using the rental bicycle and related activities.
  5. Suppose the user is under 18 years of age. In that case, the user must be accompanied by a person with parental authority or over 18 years of age (from now on referred to as “guardian”) during the rental period. If the Parent/Guardian cannot be accompanied, the Parent/Guardian’s consent to use the rental must be confirmed by the facility. The Parent/Guardian shall be jointly and severally liable for any responsibilities under these Terms and Conditions.
  6. Other persons whom the facility deems suitable for use.

レンタル品は、以下の全項目に適合する利用者のみ、利用することができます。 

  1. 本施設の本規約およびその他の交通規則等を守ることができる方。 
  2. 本施設からの連絡が可能な連絡手段の確保ができる方。 
  3. 酒気を帯びていない方。 
  4. 利用者が日本国籍を有しない場合、レンタサイクルの利用及び、それに伴うアクティビティ中の怪我や損害賠償に対して、十分な補償を有する旅行保険に加入している方。
  5. 18 歳未満の場合、貸出期間中、親権者または 18 歳以上の方（以下「保護者」といいます）が同伴できる方。同伴できない場合は、保護者のレンタル利用への同意が本施設で確認できる方。保護者は本規約に基づく責任を本人と連帯して負うものとします。 
  6. その他、本施設が利用に適すと判断した方。

 The Hour of Use / 利用時間

The hours of use of the rental bicycles are the hours applied for at the time of application. However, the bicycle rental service may be temporarily closed for the Operator’s convenience or in the event of a disaster, so please inquire with the Operator in advance.

レンタサイクルの利用時間は、利用申し込み時に申請した時間とします。ただし、運営者の都合及び災害時には臨時休業する場合がございますので、予め運営者にご照会ください。

Fees / 利用料金

One electric-assist mountain bike: 8,000 yen per day

  1. The usage time includes the time for reception, condition check, etc.
  2. Please pay any additional charges incurred on the day of use by the end of the day.
  3. Fees are subject to change due to consumption tax revisions, etc.
  4. The operator may offer discounts in consideration of other applications, etc.

電動アシストマウンテンバイク１台：8,000円 / １日

  1. 利用時間内には受付、状態確認等の時間も含みます。
  2. 当日に発生した追加料金等は、当日中にお支払いください。
  3. 利用料金については、消費税の改定等により変更する場合があります。
  4. その他の申込みなどを鑑みて、運営者が割引を提供する場合がございます。 

Application Procedure / 利用申込手続き

The application procedure is as follows;

  1. Fill out the required information on the Rental Application Form.
  2. Submit the Rental Application Form online. The staff at this facility will check your ID card and make a photocopy or take down the number, etc.
  3. Settle the rental fee. In principle, the rental price is to be paid in advance.
  4. The staff of the facility will explain and confirm the handling method for the rental items to be rented.
  5. The facility staff will adjust the rental items to the user’s needs as necessary.
  6. The facility staff and the user will check the rental items to ensure they are in good working order.
  7. The facility staff hands over the rental items to the user.

Please note that the insurance provided by the Facility covers only limited cases, such as third-party liability. Injuries to the User or damage to personal belongings may not be covered. We recommend that Users carry personal accident insurance if necessary.

利用申込の手続きは、以下の通りです。

  1. レンタル申込書に所定事項を記入します。 
  2. レンタル申込フォームをオンラインで提出します。本施設のスタッフは、身分証明書を確認の上、複写もしくは番号等を控えさせていただきます。
  3. 貸出料金の精算を行います。貸出料金は、別途定めた通りとし、原則として 前払い で精算するものとします。 
  4. 本施設のスタッフが、貸し出すレンタル品について、取扱い方法の説明や確認を行います。 
  5. 本施設のスタッフは、必要に応じ、利用者に合わせてレンタル品を調整します。 
  6. 利用者と本施設のスタッフが一緒に、レンタル品に整備不良がないことを確認します。 
  7. 本施設のスタッフが、利用者にレンタル品をお渡しします。

なお、本施設で加入している保険は、第三者への賠償責任など一部のケースのみが対象となります。利用者ご自身の怪我や所持品の損害については補償対象外となる場合がありますので、必要に応じて個人で傷害保険等に加入することをおすすめします。

Returnig Rental Items / レンタル品の返却

  1. Users must return rental items by the scheduled return time.
  2. Rental items must be returned in the same condition as when they were rented. If there is any abnormality or malfunction, please inform the facility staff immediately.
  3. Users will not be held responsible for minor stains or scratches resulting from everyday use.
  1. 利用者は、レンタル品を返却予定時間までに返却してください。 
  2. 貸出商品は、貸し出したときと同じ状態で返却してください。異常または故障があった場合には、速やかに本施設のスタッフにお伝えください。 
  3. 通常の使用に伴う、軽微な汚れや傷については、利用者の責任を問いません。

Formation of rental agreement / 貸渡契約の成立 

  1. The rental Agreement shall be concluded when the facility receives the rental fee and hands the rental items to the user.
  2. Suppose the facility cannot rent the rental items reserved by the User due to accident, theft, or other reasons beyond the facility’s control. In that case, the facility reserves the right to cancel the reservation made by the User.
  1. レンタル品の貸渡契約は、本施設が貸出料金を受け取り、利用者にレンタル品を渡したときに成立します。 
  2. 事故盗難その他、本施設の責によらない事由により、利用者が予約したレンタル品を貸し出すことができない場合には、本施設は利用者からの予約への承諾を取り消すことができるものとします。 

Invallid Application / 利用申込の無効

Suppose a user falls under any of the following items during the rental period. In that case, the facility reserves the right to void the user’s application and demand the immediate return of the rental items without notice. In such a case, the rental fee received by the facility by the “Application Procedures” will not be returned at all.

  1. The user has committed an act in violation of these Terms of Use.
  2. When an accident occurs due to reasons which are attributable to the user.
  3. When the user no longer meets the eligibility requirements for use.

本施設は、利用者が貸出期間中に次の各号の一に該当したときは、何らの通知をすることなく利用者からの申込を無効とし、直ちにレンタル品の返還を請求することができるものとします。 この場合、「利用申込手続き」に順じて本施設が受け取った貸出料金は一切返納いたしません。 

  1. 本利用規約に反する行為を行ったとき。 
  2. 利用者の責に帰する事由により事故を起こしたとき。 
  3. 利用資格に該当しなくなったとき。 

Exceeding the period of use / 貸出期間超過 

  1. If you miss the scheduled return time, contact the facility immediately.
  2. If the rental period is exceeded, the user shall pay the rental fee for the excess period.
  3. If a delay in returning the equipment causes damage to a third party, such as making it unavailable for use by the next applicant, the user shall compensate the third party for the damage.
  4. If the rental is returned after the scheduled return time and the user has yet to contact us, we may confirm the rental by phone, mail, or e-mail. Please note that even if the user does not get the notification, additional charges will be incurred by these Terms and Conditions.
  1. 返却予定時間を過ぎそうな場合、速やかに本施設まで連絡してください。 
  2. 貸出期間を超過して返却した場合、利用者は超過した期間のレンタル料金を支払うものとします。 
  3. 返却遅延により次の申込者が使用できない等、第三者に損害を与えた場合は、利用者がその損害を賠償するものとします。 
  4. 返却予定時間を経過しても、利用者からの連絡がなく返却がない場合は、電話・郵便・電子メール等で確認させていただく場合があります。なお、ご連絡をしない場合であっても、本規約に従い、追加料金は発生します。 

Trouble / 故障・破損 

  1. In case of breakdown or damage to the rental items, please stop using them immediately and contact the facility.
  2. If the rental items are broken or damaged due to reasons attributable to the user, the user may be charged for the amount of the damage.
  1. レンタル品について、故障または破損した場合は、直ちに使用を中止し、本施設まで連絡してください 
  2. 利用者の責に帰すべき事由により、レンタル品を故障または破損した場合、損害金額を利用者に請求する場合があります。 

Theft and Losing / 盗難・紛失 

  1. In the event of theft or loss of rental items, please notify the facility immediately.
  2. If rental items are stolen or lost due to reasons attributable to the user (e.g., leaving the bicycle unlocked in a public place), the user may be charged for the amount of damages.
  1. レンタル品について、盗難または紛失があった場合は、速やかに本施設まで連絡してください。 
  2. 公共の場で施錠せずに放置するなど、利用者の責に帰すべき事由により、レンタル品を盗難または紛失した場合、損害金額を利用者に請求する場合があります。 

Accident / 事故 

  1. In the event of an accident during the rental period, please contact the facility immediately.
  2. The User must also immediately contact the police in addition to informing the Facility, especially if personal injury or damage to others is involved. The User is solely responsible for the cost of settlement or legal proceedings if the accident is caused by the User’s negligence.
  3. If the user causes damage to the facility or a third party due to reasons attributable to the user, the user shall compensate the third party for the damage.
  4. In the event of injury or other damage, while using the rental bicycle, compensation will be made within the scope of the insurance coverage provided by the facility.
  5. If settlement of an accident is necessary, the user shall be responsible for such payment. The facility assumes no responsibility for accidents.
  6. The facility will not be responsible for any damage to users or third parties caused by bicycle malfunctions.
  1. 貸出期間中に事故にあった場合、速やかに本施設まで連絡してください。 
  2. 人身事故や第三者への損害を伴う場合は、施設への連絡に加え、速やかに警察にも通報してください。事故が利用者の過失によるものである場合、示談や訴訟費用等も含め、利用者自身が一切の責任を負うものとします。
  3. 利用者の責に帰すべき事由により、本施設または第三者に損害を与えた場合、利用者はこれを賠償するものとします。 
  4. レンタサイクル利用時の傷害等につきましては、本施設加入の保険適用の補償範囲内で、補償いたします。
  5. 事故についての示談等が必要な場合には、利用者自らの責任で行っていただきます。本施設は、事故についての一切の責任を負いません。 
  6. 自転車の故障によって利用者や第三者に損害が発生したとしても、本施設は一切の責任を負いません。 

Prohibited Acts / 禁止行為

  1. During the rental period, the user shall only allow the user who has filled out the rental application form to use the loaned product.
  2. Reckless driving, driving under the influence of alcohol, or other acts that violate traffic regulations.
  3. Use of the products in dangerous or inappropriate places or methods.
  4. Actions that obstruct the passage of pedestrians and other pedestrians
  5. Alteration or modification of the structure or equipment of the loaned product
  6. Riding without a helmet
  7. Leaving the bicycle unattended and unlocked in public areas
  8. Other activities that violate laws, regulations, and rules
  1. 利用者は、貸出期間中、レンタル申込書に記入した使用者以外の方に、貸出商品を使用させてはいけません。 
  2. 無謀な運転、酒気帯び運転、その他交通規則に違反する行為。 
  3. 危険箇所、不適当な場所または方法での使用。 
  4. 歩行者等の通行障害となるような行為。 
  5. 貸出商品の構造・装置等の改造および変更。 
  6. ヘルメット無着用での走行。 
  7. 自転車を公共の場所で無施錠のまま放置する行為。
  8. その他、法令諸規則に反する行為。 

Termination due to inevitable force / 不可抗力事由による途中終了 

The rental agreement shall terminate if the loaned equipment becomes unusable during the loan period due to a natural disaster or other force majeure event beyond the control of the SPA or the User. In such a case, the User shall promptly notify the Facility and agree that the rental fee will not be refunded.

貸出期間中、天災その他の本施設および利用者のいずれの責めにも帰さない不可抗力の事由により、貸出商品が使用不能となった場合 には、貸渡契約は終了するものとします。この場合、利用者はその旨を本施設に速やかに連絡するものとし、貸出料金が返還されないこと を予め承諾します。 

Others / その他 

If any question arises regarding the contents of these Terms and Conditions, or if any matter arises that is not stated in these Terms and Conditions, the User and the Facility shall consult with each other in good faith and endeavor to resolve the matter.

本規約の内容に疑義が生じた場合、または本規約に記載していない事項が生じた際は、利用者、本施設は、誠意を持って協議し、 解決に努めるものとします。 

Courts / 合意管轄裁判所

In the event of any dispute concerning rights and obligations under these Terms and Conditions, the parties agree to submit to the district court’s jurisdiction over the Facility.

本規約に基づく権利および義務について紛争が生じたときは、本施設を管轄する地方裁判所をもって管轄裁判所とすることに合意します。
